These Terms of Use ("Terms") govern your use of haulvix.com, its estimate calculator, and its forms (the "Site"). Kyle Biancardi, doing business as Haulvix ("Haulvix," "we," "us"), operates haulvix.com. By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Referral service only. Haulvix is a referral service. We collect information about your business and its equipment financing needs and, with your consent, refer you to one or more third-party lending partners. Haulvix is not a lender, does not make loans or leases, does not make credit decisions, and does not act as your agent, broker, or advisor.
2. No offer to lend. Nothing on the Site, including any calculator result, is an offer, commitment, or pre-approval to lend or lease. Any financing is offered only by a lending partner, on its own terms, after its own review, and subject to credit approval.
3. No fee to you. Haulvix does not charge you a fee for using the Site or for our referral. Lending partners may charge their own fees, which they will disclose to you.
4. How we are paid. Haulvix is compensated by lending partners, usually when a business we refer is funded. Compensation may differ by partner and product, which may influence which partners we work with. We do not represent that any partner offers the best rate or terms available.
5. Business purpose only. The Site is only for equipment leases and loans for equipment used primarily for business or commercial purposes. It does not offer or refer merchant cash advances or revenue-based financing. It is not for personal, family, or household purposes, and you must not use it for consumer financing. You must be at least 18 and authorized to act for the business you represent.
6. Accuracy of your information. You agree that the information you submit is true, accurate, and complete, that you are authorized to submit it (including information about owners or guarantors), and that the phone number you give is yours or one you are authorized to use. Lending partners may rely on what you submit.
7. No guarantee. We do not guarantee that you will be matched with a lending partner, that any partner will contact you or approve you, or any rate, term, payment amount, or funding time. Calculator results are estimates for illustration only.
8. Lending partners' own terms. Each lending partner is independent. If you apply with a partner, its own application, agreements, disclosures, and privacy policy govern that relationship. Haulvix is not responsible for a partner's products, decisions, communications, or conduct.
9. Phone calls; no text messages. If you give us your phone number when you book a call, in our chat, or on a form, you are asking Haulvix to call you about your equipment financing request. Our calls are dialed by a person, not by an autodialer, and we do not use prerecorded or artificial voice messages. Haulvix does not send text messages. Giving your phone number is not a condition of any purchase or of obtaining financing. To stop calls, tell us on a call or email [email protected]. 10. Acceptable use. You may not misuse the Site, submit false or someone else's information without authority, scrape or copy the Site, interfere with its security, or use it for any unlawful purpose.
11. Intellectual property. The Site and its content, design, calculator, and trademarks are owned by or licensed to Haulvix and are protected by law. You may use the Site only for your own business's financing request. No other license is granted.
12. Disclaimer. THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, Haulvix DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. Content on the Site is general information, not financial, tax, or legal advice.
13. Limitation of liability. TO THE FULLEST EXTENT ALLOWED BY LAW, Haulvix WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA, ARISING FROM THE SITE, OUR REFERRAL, OR ANY LENDING PARTNER'S ACTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). You agree to indemnify Haulvix for claims arising from information you submit or your breach of these Terms.
14. Governing law. These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Connecticut.
15. Changes. We may change these Terms by posting a new version with a new effective date. Your continued use of the Site after that means you accept the changes.
